Legal Consultation
Register for GST is a vital step for businesses in India to ensure
compliance with the Indian tax system. It is mandatory for businesses whose turnover exceeds the prescribed threshold limit. Failing to register for GST can lead to legal penalties and complications, making it an essential requirement for all businesses to stay on the right side of the law.
One of the primary benefits of registering for GST is the ability to claim input tax credit (ITC). This credit allows businesses to offset the tax paid on raw materials or services used in business operations, thus reducing the overall tax liability. This helps businesses maintain a competitive edge by lowering operational costs.
Another significant advantage of registering for GST is the credibility it
brings to the business. With GST registration, companies gain access to larger markets, government contracts, and the ability to trade across state lines without any tax hurdles. Additionally, businesses with GST registration can engage in smooth inter-state transactions without any restrictions, ensuring easier operations.
For businesses in e-commerce, register for GST is a must. Online sellers on platforms like Amazon, Flipkart, and others must be GST-registered to legally sell products across India. This registration ensures smooth transactions and simplifies business operations on these platforms.
Furthermore, registering for GST allows businesses to apply for refunds on excess taxes paid, which is especially beneficial for exporters. The simplified process of applying for refunds under the GST system provides additional financial relief for businesses operating in the export sector.
In summary, register for GST ensures legal compliance, provides financial advantages, enhances business credibility, and facilitates smooth operations
across India, making it an essential step for all businesses.
According to the GST Act of 2017, if your business has an annual turnover of over ₹40 lakh (or ₹20 lakh in some special category states), GST registration is mandatory. It’s also compulsory for eCommerce sellers, no matter their turnover.
GST stands for Goods and Services Tax. It is a single tax that is applied on the sale of goods and services in India.
Before GST, there were many different taxes like VAT, service tax, excise
duty, etc. GST has replaced all those taxes and made the system simpler.
GST is charged at every step of buying or selling—like from manufacturer to wholesaler, wholesaler to retailer, and retailer to customer. But the tax is
only paid on the value added at each step, so there is no double taxation.
There are 3 types of GST:
A unique 15-digit number known as the Goods and Services Tax Identification Number (GSTIN) is obtained for your company during the GST registration process. This number makes your business officially registered under the GST
system and allows you to collect and pay GST.
VAT, service tax, and excise duty were superseded by the GST, a single indirect tax. It is multi-stage and destination-based, which means it is charged at every step of the supply chain but only on the value added at each stage.
For Individuals / Sole Proprietors
For Partnership Firms / LLPs
For Private Limited / OPC / Other Companies
Normal Taxpayer
If your business has an annual turnover exceeding ₹40 lakh (or ₹20 lakh in special category states), you must register for GST. This applies to most businesses operating in India.
Composition Scheme
Small businesses with an annual turnover of up to ₹1.5 crore (₹75 lakh in some states) can register for GST under the Composition Scheme. This allows them to pay tax at a fixed rate with reduced compliance, though they can't claim input tax credit or do inter-state sales.
Casual Taxable Person
If you occasionally supply goods or services in a different state (e.g., during exhibitions or trade fairs), you are required to register for GST as a casual taxable person. This registration is valid for 90 days and can be extended.
Non-Resident Taxable Person
Foreigners or businesses located outside India who supply goods or services within the country must register for GST as non-resident taxable persons. This temporary registration is also valid for 90 days.
E-Commerce Operator
Anyone operating or managing online platforms like Amazon, Flipkart, or any
independent e-commerce site must register for GST, regardless of turnover.
Input Service Distributor (ISD)
If your business has a head office that distributes input tax credit to multiple branches, you need to register for GST as an Input Service Distributor to manage credit allocation.
TDS / TCS Deductor under GST
Government departments or e-commerce operators responsible for deducting TDS or TCS must also register for GST as per the GST Act.
