Step-by-Step Trademark Registration Process

Preliminary Trademark Search

Make a detailed search on the national IP database (e.g., IP India for India, USPTO for the USA) to verify that your suggested mark is distinct and does not infringe any already registered trademarks.

Determine the Appropriate Trademark Class

Identify the applicable class(es) under the Nice Classification system that match the goods or services your mark will cover. This ensures proper classification and protection.

Prepare the Application

  • Trademark representation (wordmark/logo)
  • Description of goods/services
  • Date of first use (where applicable)
  • Power of Attorney (where filed by an agent or attorney)


File the Trademark Application

  • Online through the official IP portal
  • Or in person at the trademark registry office

You will be issued an acknowledgment with an application number.

Examination by the Trademark Office

  • Compliance with formality
  • Distinctiveness and risk of confusion
  • Any legal grounds for refusal

Office Action (if any objections)

  • If objections are raised, a formal examination report is issued. You must respond within the stipulated time (typically 30 days), either:
  • By filing a reply on legal grounds, or
  • Attending a hearing (if scheduled)


Publication in Trademark Journal

If the application is approved or objections are cleared, the trademark is published in the official journal for public scrutiny. The window for opposition is generally 3–4 months.

Opposition Period

  • If no third-party oppositions are received (or resolved in your favor), the application goes on to registration.

Trademark Registration Certificate

  • When the opposition period ends successfully, the registrar grants the registration certificate, and your trademark is formally protected for 10 years.

Trademark Renewal

Trademarks need to be renewed every 10 years to keep protection. Renewal may be filed within 6 months before expiry or a grace period (with a surcharge).
